Terms of Use

These terms apply to everyone who uses Cape Summer at capesummersa.co.za: visitors, season pass holders and venues. By creating an account, buying a season pass or listing a venue, you agree to them.
Please read the clauses in bold carefully. They limit our responsibility, set out risks you take on and explain when we can suspend an account. The Consumer Protection Act requires us to draw your attention to them.
1.What Cape Summer is
Cape Summer is an information guide: a day-by-day calendar of events, parties, food and drink, culture and conferences across the Western Cape from 1 November 2026 to 31 March 2027.
Cape Summer is not a booking agent, ticket seller or event organiser. We do not sell tickets, reserve tables or take bookings on anyone's behalf. Each listing links to the venue's own ticket page where they have one, or to their own post. Any booking, ticket or payment for an event is a contract between you and that venue or organiser, on their terms.
2.Where listings come from
Most listings are gathered automatically from venues' and promoters' public Instagram posts and websites, read with the help of software, including AI. Venues can also submit their own events.
Event details change and posts can be misread. Dates, times, prices, line-ups and availability may be wrong, out of date or changed by the venue without notice, and events can be cancelled. Always confirm the details with the venue before you travel, book or pay. If you spot a mistake, tell us at connectme@data-inc.co.za and we will correct or remove it.
3.Accounts
- You sign in with a one-time code sent to your email. Keep access to that inbox secure.
- You must be 18 or older to create an account or buy a season pass. Parents and guardians are welcome to use the calendar to plan family outings; children should not hold their own account.
- One account per person. Give us accurate details.
- You are responsible for what happens under your account.
4.The season pass
- The season pass costs R499, paid once by card through our payment provider, Yoco. There is no subscription and no automatic renewal.
- It unlocks the full calendar and My Summer for one person, from the moment of payment until 31 March 2027.
- It is personal. You may not share, resell or transfer it, or let others use your account.
- We never see or store your card number. Yoco processes the payment.
- Refunds are covered in our Refund Policy: a full refund if you ask within 7 days of paying.
Features we describe as planned or not yet live, such as alerts, are not part of what you pay for until we switch them on.
5.Going out safely
You attend events at your own risk. The venues and organisers are responsible for their events, entry rules, age limits (some welcome families, others are adults only), safety, conduct and refunds. We have no control over them and are not responsible for anything that happens at or on the way to an event. Drink responsibly, and never drink and drive.
6.Using the site fairly
You may not:
- copy, scrape or republish the calendar or its listings in bulk, by hand or by automated means
- share your account or pass, or resell access
- harass venues, other users or our team, or post anything unlawful, abusive or misleading
- try to get around the paywall, interfere with the site or its security, or test it for weaknesses without our written permission
- use the site for anything illegal
If you break these rules we may suspend or close your account without notice. Where the breach is serious, such as sharing or reselling a pass, scraping or abuse, we may do so without a refund. We will tell you why, and you can reply to connectme@data-inc.co.za if you think we got it wrong.
7.Venues and promoters
- Listing a venue is free. We may decline or remove a listing at our discretion.
- By registering, you confirm that you are entitled to represent the venue and that the details you give us are accurate.
- We may read your public posts and website to list your events, and link to them. Tell us if you would rather we didn't, and we will stop.
- A boost is paid placement for one event in the 7 days before it. It improves visibility in the calendar; it does not guarantee attendance, sales or any particular result. Boosts are paid upfront and are refundable only if we fail to run them.
- You are responsible for your events, your guests' experience and your own bookings and refunds.
8.Content and ownership
The Cape Summer name, design, software and the way the calendar is compiled belong to Incorporated Data (Pty) Ltd. Venue names, logos, photos and posts belong to their owners; we show and link to them to point you to their events. If you own content on the site and want it removed, email connectme@data-inc.co.za and we will act promptly.
9.Our responsibility to you
We provide the calendar as it is. To the extent the law allows, we do not guarantee that it is complete, accurate or always available, and we are not liable for any loss arising from events, venues, travel, bookings made with third parties, or decisions you make based on a listing.
Where we are liable to you, our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits a right you have under the Consumer Protection Act or other law that cannot be excluded, or our liability for gross negligence or deliberate wrongdoing.
10.Changes, notices and the law
- We may update these terms. The date at the top shows the latest version. If a change materially affects pass holders, we will email you first.
- Notices to us go to connectme@data-inc.co.za or the physical address below. Notices to you go to the email on your account.
- These terms are governed by South African law. Disputes go to the courts of South Africa, including the Magistrates' Court that has jurisdiction.
- If a complaint can't be resolved with us, you may approach the Consumer Goods and Services Ombud or the National Consumer Commission.
Cape Summer is operated by Incorporated Data (Pty) Ltd trading as Data Inc, a private company registered in South Africa.
